1. OUR SERVICES
We provide, through the preSenCe website, a digital space dedicated to self-exploration, inner transformation, and personal development through individual guidance, resources, and digital offers.
The Somavibratory™ method is a complementary and holistic approach that works on emotional, somatic, and energetic levels.
It is in no way a substitute for medical, psychological, or psychiatric follow-up.
It does not aim to establish a diagnosis, nor to prevent, treat, or cure any disease.
In case of physical or psychological health issues, it is the participant’s responsibility to consult a doctor or qualified health professional.
The Somavibratory™ method may complement therapeutic follow-up, but it does not replace it.
Our services are designed for an adult audience. If you are under 18, we ask you not to use this site.
Certain specific regulations (in the fields of health, finance, or other regulated sectors) may not be compatible with the use of our services. If this is your case, we ask you to exercise discretion and not use our services in a context that is legally incompatible.
If you access our site from abroad, you are responsible for complying with the laws applicable in your country of residence.
2. INTELLECTUAL PROPERTY
Everything offered on our site – written content, visuals, videos, concepts, structure, logo, as well as our methods – is protected by Swiss and international intellectual property laws.
The term Somavibratoire™, as well as its linguistic variants (Somavibratory™ in English, Somavibratorio™ in Spanish and Italian), is an exclusive creation developed by Silvana Carnevale.
These names and all their variations, in all languages – including but not limited to: “Somavibratoire™ method,” “Somavibratoire™ approach,” “Somavibratoire™ release,” “Somavibratoire™ guidance,” “Somavibratoire™ practice” – are used here as distinctive marks identifying a unique method.
Any reproduction, adaptation, dissemination, or use of these terms and variations, in whole or in part and in any form whatsoever, without prior written authorization from Silvana Carnevale, is strictly prohibited and may give rise to legal action.
Likewise, the name preSenCe, written with a capital “S” and “C,” constitutes a distinctive name and exclusive creation of Silvana Carnevale. Any reproduction, imitation, adaptation, dissemination, or use of this name, in whole or in part and in any form whatsoever, without prior written authorization, is strictly prohibited.
This protection also extends to all orthographic, graphic, or typographic variations, as well as translations and adaptations in other languages (for example: “PresenCia,” “PreSenza,” or any other variation aiming to reproduce or imitate the preSenCe brand).
The Somavibratory™ method is an exclusive creation developed by Silvana. It is protected under applicable intellectual property laws. Any reproduction, adaptation, dissemination, or use, in whole or in part, without prior written authorization, is strictly prohibited and may give rise to legal proceedings.
The name Somavibratory™ is used here as a distinctive mark identifying Silvana’s unique approach.
These elements are the exclusive property of preSenCe or are used with authorization.
You are authorized to consult, read, or save certain content for personal use only.
Any other form of use (reproduction, publication, distribution, commercial exploitation) is prohibited without our prior written consent.
If you wish to reuse or distribute certain content in an educational, artistic, or professional context, please contact us at: contact@presencesilvana.com
3. USER COMMITMENTS
By using our site or accessing our services, you confirm that you:
-
have the legal capacity to accept these Terms,
-
are 18 years or older,
-
do not use our site via automated means (bots, scripts, etc.),
-
do not misuse our services for illegal or unethical purposes,
-
agree to comply with the laws applicable in your country.
If you provide inaccurate, outdated, or misleading information, we reserve the right to suspend or disable your access to all or part of the Services, temporarily or permanently.
We ask every person to act with authenticity, respect, and kindness in their use of the site — as preSenCe is a space created to awaken, not to harm.
4. PRODUCTS
The products and services offered on our site include, in particular:
– individual guidance,
– digital programs,
– downloadable resources,
– and other offers related to personal development and inner transformation.
We do our best to present our offers with clarity, honesty, and transparency, but it may happen that a product or resource is no longer available without prior notice.
We reserve the right to modify, suspend, or withdraw any product at any time, without having to justify our decision.
5. ORDERS AND PAYMENTS
Payments are made in Swiss francs (CHF) through secure platforms such as Stripe or Calendly.
By placing an order, you agree to:
– provide accurate information (email address, payment method, etc.),
– update your details if necessary,
– assume full responsibility for payment upon confirmation of your order.
Applicable taxes will be added to the final amount if necessary.
We reserve the right to refuse or cancel a booking, particularly in cases of suspicious behavior, attempted fraud, or abusive use of the service (e.g. automated orders, resales, etc.).
Any session booked may be rescheduled up to 24 hours before the appointment. After this deadline, the session is considered due and will not be refundable.
6. REFUND POLICY
Sales made on our site are final.
No refunds, exchanges, or returns will be granted, unless otherwise stated clearly in the relevant offer.
Why? Because our services (whether digital or human) involve immediate access to sensitive, personalized, or non-reproducible content.
We encourage you to read the descriptions carefully before confirming your purchase. If you have doubts, feel free to contact us at contact@presencesilvana.com before ordering.
In the event of an impediment due to force majeure (illness, unforeseen emergency, technical issue), preSenCe may reschedule the session or service concerned, without any obligation of refund.
7. PROHIBITED USE
The space we have built at preSenCe is based on respect, integrity, and transformation.
To preserve this, we ask you not to use our Services for purposes that:
– violate the law or the rights of others,
– reproduce, copy, or redistribute our content without authorization,
– interfere technically with the proper functioning of the site,
– are motivated by fraud, manipulation, or abusive data collection,
– send spam, viruses, or other malicious content,
– aim to harm, harass, or discredit the team or other users.
We reserve the right to suspend access to our services without notice if these rules are not respected.
8. USER-GENERATED CONTENT
Our site does not currently offer interactive areas where users can publish content visible publicly.
However, if you send us texts, testimonials, comments, ideas, or any other content (hereinafter referred to as “contribution”), by email or via a form, you:
– authorize us to use it freely in our communication (site, newsletter, etc.),
– guarantee that this content belongs to you or that you have the necessary rights,
– confirm that it does not infringe on the rights of others, nor is it offensive, illegal, or discriminatory.
We reserve the right to refuse or remove any contribution deemed inappropriate, without justification.
9. RIGHTS TO CONTRIBUTIONS
By sending us a suggestion, feedback, message, testimonial, or any other form of content:
– you grant us a free, non-exclusive license to use, publish, translate, or adapt it on any medium related to preSenCe,
– you agree that we may integrate it into our communications, respectfully and in line with our intent.
This does not mean we become the owner of your content: you retain your rights. But you authorize us to share or edit it if it serves the message we wish to transmit.
No publication will be made without awareness. If you change your mind after sending, simply contact us and we will remove your contribution as soon as possible.
10. THIRD-PARTY SITES AND CONTENT
Our site may contain links to other sites, platforms, or content from third parties (“third-party content”).
While we sometimes share external resources or tools in good faith, we cannot guarantee or monitor the quality, safety, or compliance of this content.
If you choose to click on an external link or use a third-party service, you do so at your own responsibility.
We encourage you to always read the terms and privacy policies of other sites before sharing data or making a purchase.
11. SITE AND SERVICE MANAGEMENT
We reserve the right — without obligation — to:
– monitor use of our site to detect abuse,
– restrict or suspend access in case of non-compliance with these Terms,
– remove inappropriate or excessively large content,
– protect the integrity of the site and the experience of its users.
We do everything possible to ensure the proper functioning of preSenCe. This includes updates, technical adjustments, or maintenance times, which we try to schedule at the most convenient times.
12. PRIVACY AND PERSONAL DATA
The confidentiality of your data is deeply important to us.
By using our site and services, you agree to the practices described in our privacy policy.
Our site is hosted in Switzerland and the United States. By browsing from another country, you agree that your data may be transferred and processed outside your local jurisdiction, in accordance with our policy.
A detailed privacy policy, compliant with the GDPR and Swiss legislation, is available on our site. We invite you to read it to understand how your data is collected, used, and protected.
13. TERM AND TERMINATION
These Terms apply as soon as you access our site or use our services — and remain valid until either party terminates them.
We may, without notice, suspend or terminate your access to the site if we believe that there is:
– non-compliance with these Terms,
– inappropriate or malicious use,
– fraudulent or unethical behavior.
You are also free to stop using our services at any time.
In case of termination, all clauses relating to intellectual property, confidentiality, responsibilities, or disputes will remain fully valid.
14. MODIFICATIONS OR INTERRUPTIONS
We reserve the right to modify, suspend, or delete at any time any part of the site, service, or content, without notice.
This may happen in particular to:
– correct information,
– update an offer,
– perform maintenance,
– or adjust our strategic direction.
We do our best to ensure continuous availability of our site, but temporary interruptions may occur. In such cases, preSenCe cannot be held responsible for any inconvenience or loss arising from this unavailability.
15. GOVERNING LAW
These Terms are governed by Swiss law.
In case of dispute, and unless otherwise required by mandatory law, the courts of Geneva shall have exclusive jurisdiction.
If you are based in a country of the European Union, you also benefit from the protection offered by the law of your country of residence, in accordance with consumer protection rules.
We are committed to finding fair and respectful solutions, in a spirit of dialogue, before initiating any legal proceedings.
In case of discrepancy between different language versions of these Terms, the French version shall prevail.
16. DISPUTE RESOLUTION
We believe in constructive and peaceful dialogue.
Before taking any legal action, we invite you to contact us directly in order to attempt an amicable resolution: contact@presencesilvana.com
If, despite our discussions, an agreement cannot be reached, any dispute will be submitted to private arbitration, according to the rules of the European Arbitration Center, in Geneva (Switzerland).
The procedure will take place in French, English, Spanish, or Italian, according to your choice.
Both parties agree that this procedure is confidential, respectful, and aims for a fair resolution, without class action.
17. UPDATES AND CORRECTIONS
We reserve the right to correct or update any content or information appearing on our site — including prices, descriptions, or technical details — at any time and without notice.
Although we do our best to ensure the reliability of the information shared, some errors may occur. Thank you for your understanding if this happens: your trust remains our priority.
18. DISCLAIMERS
The services offered by preSenCe are provided “as is,” in awareness and with goodwill.
However, we cannot guarantee that access to the site will be uninterrupted, error-free, or virus-free.
We also make no promise regarding the personal or professional results you may derive from the use of our services — as each transformation is unique to each person.
You use the site at your own responsibility, in respect of your pace, your choices, and your personal capacities.
19. LIMITATION OF LIABILITY
To the fullest extent permitted by law, preSenCe cannot be held liable for:
– indirect, consequential, or incidental damages,
– loss of data, revenue, or opportunities,
– technical bugs or site unavailability,
– inappropriate or diverted use of our services.
In case of a proven dispute, our liability will be limited, at most, to the amount you paid for the service concerned in the month preceding the reported issue.
20. INDEMNIFICATION
By accepting these Terms, you agree to protect and indemnify preSenCe, as well as its partners, collaborators, or service providers, against any claim or demand related to:
– your use of the site or services,
– a violation of these Terms,
– an infringement of a third party’s rights (e.g., intellectual property, personal data),
– or any harmful behavior toward another person through our services.
This means that if your actions cause a dispute or damage, you agree to assume legal responsibility.
21. USER DATA
We may retain certain information you provide to us in the course of using the site, in particular for:
– the proper functioning of our services,
– exchanges related to your purchases,
– or for analysis purposes (always in compliance with our privacy policy).
Even though we make regular backups, you remain responsible for your own personal data (especially in case of loss of access or content shared from your device).
We cannot be held responsible for any loss or corruption of data related to your device or inappropriate use of the site.
22. ELECTRONIC SIGNATURES AND COMMUNICATIONS
By using our site, completing a form, or making a purchase, you agree that:
– our exchanges may be conducted electronically (emails, notifications, forms),
– such communications have the same legal value as printed documents or handwritten signatures.
You also consent to the use of electronic signatures and the conclusion of contracts via our services, in accordance with applicable laws.
23. CALIFORNIA USERS

To exercise this right, you can write to us at: contact@presencesilvana.com
24. FINAL PROVISIONS
These Terms constitute the entire agreement between you and preSenCe.
If any clause is deemed invalid or unenforceable, this will not affect the validity of the other provisions.
No delay or omission in enforcing a clause shall constitute a waiver of that right.
We may, at any time, assign or transfer our rights and obligations to a third party, without prior notice.

and your personal responsibility.
We provide tools, a safe environment, and attentive presence — but you remain the sole actor of your transformation.
No promise of quick or specific transformation is made.

Chaque chemin est unique, influencé par :
* votre engagement,
* votre ouverture au processus,
* et votre responsabilité personnelle.
